Vote NO on HJR4: Defend Idaho Voter Rights and Medical Cannabis

Election Day is Tuesday, November 3, 2026 – and Idahoans will face a crucial vote on House Joint Resolution 4 (HJR4). This measure, if passed, would amend the Idaho Constitution to strip voters of the power to legalize cannabis (and even other drugs) via ballot initiatives, handing exclusive authority over such decisions to the state legislature. In plain terms: HJR4 is a power grab. It targets medical marijuana and the citizen initiative process in one blow. We urge you to vote NO on HJR4 to protect the rights of Idaho citizens and keep the door open for compassionate medical cannabis laws. Time is short – the stakes for democracy and patient access in Idaho have never been higher.
What Is HJR4?

HJR4 is a proposed constitutional amendment referred to voters by the Idaho Legislature in 2025. The amendment’s text is alarmingly straightforward: it would declare that “only the Idaho Legislature shall have power and authority to legalize” the growing, selling, or use of “marijuana, narcotics, or other psychoactive substances.” In effect, HJR4 aims to eliminate Idahoans’ ability to legalize cannabis through a citizen-led ballot initiative. Right now, Idaho’s Constitution allows citizens to propose and vote on laws (through initiatives) when lawmakers fail to act. HJR4 would carve out an exception, banning any future voter initiative that tries to legalize cannabis or other drugs. The legislature passed HJR4 largely along party lines in 2025, and it will appear as a question on the 2026 general election ballot. A majority “Yes” vote on HJR4 would amend the constitution and slam the door on any voter-approved marijuana reform. A “No” vote leaves that power in the hands of the people.
Why did this happen? Idaho lawmakers supportive of HJR4 have made it clear they want to “go on the offense” against marijuana legalization efforts. The bill’s lead sponsor framed it as protecting the “virtue and sobriety” of Idaho, fearing that voters might legalize medical or recreational marijuana if given the chance. Indeed, conservative legislators have worried for years that Idahoans would legalize marijuana through a ballot measure, and they’ve repeatedly tried to tighten initiative rules since 2019. Now, with HJR4, they’re trying a new tactic: simply remove the voters from the equation on this issue.
A Dangerous Precedent – More Than Just Cannabis

While HJR4 is pitched as an anti-marijuana amendment, its impact reaches far beyond cannabis policy. By stripping away the public’s ability to enact certain laws, HJR4 undermines the very foundation of direct democracy in Idaho. Today they’re targeting marijuana, but tomorrow it could be any issue Idaho citizens care about. If lawmakers can carve out one topic (like cannabis) and declare it off-limits to citizen initiatives, what stops them from doing the same for other issues – whether it’s health care, education, minimum wage, or reproductive rights? This is how dangerous precedents are set.
Idahoans have a proud history of using ballot initiatives to pass popular policies when the legislature won’t. (Recall that in 2018, voters took it upon themselves to expand Medicaid health coverage via a ballot initiative when legislators had stalled – a clear example of citizens exercising their rights.) HJR4 threatens to erode this safety valve of citizen action. It sends a chilling message: “trust the legislature or nothing.” That notion should alarm everyone, regardless of where you stand on cannabis. Even those personally opposed to marijuana legalization should be concerned by this overt attack on voter power. As Paul Armentano of NORML put it, “Whether or not one personally supports or opposes cannabis legalization, these overtly undemocratic tactics ought to be a cause of deep concern.” In our republican form of government, we elect representatives – but we also reserve rights to ourselves as the people. HJR4 would chip away at those rights. We cannot allow this constitutional power grab to succeed.
Idaho’s Cannabis Laws: Out of Step with the People

It’s no wonder lawmakers are nervous about voters weighing in – Idaho’s official stance on cannabis is one of the most extreme in the nation, and it’s wildly out of step with public opinion. Currently, cannabis in Idaho is fully illegal for any use – recreational or medical. Idaho is now one of the last holdouts in the entire country with a complete ban on medical marijuana. (In fact, Idaho and Nebraska are reportedly the only two states left with no form of medical cannabis allowance at all.) Possession of even small amounts can land you with a criminal charge.
Meanwhile, all our neighboring states have legalized cannabis in some form – from Washington, Oregon, and Montana (where recreational use is legal), to Utah (which has medical cannabis) – leaving Idaho isolated. It’s no exaggeration to say Idaho is an “island of prohibition surrounded by a sea of cannabis common sense,” as the advocacy group Legalize Idaho puts it.
Yet, Idaho citizens do want change. Polls show that nearly 70% of Idahoans believe medical marijuana should be legal. Families, patients, and veterans across Idaho have been pleading for the freedom to use cannabis for legitimate medical needs – to ease chronic pain, control epileptic seizures, treat PTSD, or alleviate chemotherapy nausea – without being treated like criminals. These are our neighbors, friends, and relatives suffering needlessly while Idaho maintains one of the most uncompromising anti-cannabis regimes in America.
How is it “compassionate” to deny a cancer patient relief, or to threaten jail for a veteran using cannabis to calm debilitating trauma? It isn’t. In fact, Idaho’s refusal to even consider medical marijuana has led to the state being labeled one of the “most illogical and least compassionate” in the nation on this issue. We are long overdue for a change in approach.
HJR4 is designed to slam the door on that change. Its backers see the writing on the wall – the public is slowly but surely embracing cannabis reform – and they want to lock in the status quo before the people can voice their will. By voting NO on HJR4, you aren’t just rejecting an abstract constitutional tweak; you’re standing up for the real people who could benefit from medical cannabis if Idaho’s laws changed. You’re saying no to prolonging suffering and no to shutting down dialogue. And critically, you’re saying yes to the principle that we the people should have a say in our state’s direction, especially on issues where the legislature has dug in its heels against popular opinion.
Idahoans Fighting Back: Legalize Idaho & Kind Idaho

The good news is, Idaho’s citizens aren’t taking this lying down. Grassroots groups are mobilizing to inform voters and stop HJR4, while also pushing forward positive cannabis reforms. Two leading organizations in this fight are Legalize Idaho and Kind Idaho. These local advocacy groups are on the front lines, and they need your support.
Legalize Idaho is a community-driven coalition dedicated to reforming Idaho’s harmful marijuana laws through education, awareness, and political action. They highlight how irrational Idaho’s prohibition stance has become and organize citizens across the state to demand change. Legalize Idaho volunteers have been hosting town halls, circulating petitions, and spreading the message that Idahoans deserve sensible cannabis policies and the freedom to choose them. They are staunchly opposed to HJR4 because it would remove the very mechanism – the citizen initiative – that could finally bring about marijuana reform in Idaho.
Kind Idaho is another powerhouse in the movement – a nonprofit focused specifically on bringing medical cannabis access to patients in Idaho. In fact, Kind Idaho is the sponsor of a 2026 ballot initiative to decriminalize personal use of marijuana and allow limited home cultivation. This citizen initiative (currently gathering signatures) would permit adults to possess up to one ounce of cannabis and grow a handful of plants at home, finally easing the threat of arrest for patients and consumers with small amounts. It’s a pragmatic step toward a full medical cannabis program, an effort born out of compassion for those suffering.
Kind Idaho’s leaders and volunteers are working tirelessly to get this measure on the ballot – which makes HJR4 all the more infuriating. If HJR4 passes, it would nullify efforts like Kind Idaho’s by ensuring that no voter initiative on cannabis could ever become law. That’s right: even if citizens collect thousands of signatures and Idaho votes to legalize medical marijuana in 2026, HJR4 (if approved) could override it, since the constitution would then forbid such voter-driven laws. This is the cynical endgame HJR4’s backers are hoping for.
Kind Idaho is actively educating voters about this threat and rallying opposition. They, along with Legalize Idaho, are providing resources, organizing events, and championing the “NO on HJR4” campaign across the state. Supporting these groups – whether through volunteering, donations, or simply spreading the word – is one of the best ways to fight back against HJR4’s attack on our rights.

How You Can Take Action

Defeating HJR4 and advancing medical cannabis in Idaho will take all of us. Here are concrete steps every Idahoan can take right now to make a difference:
- Register to Vote and Check Your Registration: Make sure you are registered to vote at your current address, so you can cast your ballot in November 2026. Visit the official state site VoteIdaho.gov to register or confirm your voter registration status. Encourage friends and family to do the same – every vote will count in this high-stakes referendum.
- Volunteer or Donate to Advocacy Groups: Both Legalize Idaho and Kind Idaho rely on grassroots support. Volunteer your time to help collect signatures, phonebank, canvass neighborhoods, or staff educational booths. If you can’t volunteer, consider donating to their campaigns. Your contribution will help fund flyers, ads, and events to inform more voters about HJR4. These groups are fighting for your rights and wellbeing, but they can’t do it alone. Even a few hours of volunteering or a small donation can have a big impact.
- Share Accurate Information on Social Media: Misinformation and confusion are enemies of fair elections. Help combat rumors by sharing factual, easy-to-understand information about HJR4 and Idaho’s cannabis issue on Facebook, Twitter, and other platforms. For example, explain to your network that HJR4 isn’t about a specific drug policy so much as it is about who gets to decide Idaho’s drug policy. Share links to informative articles, videos, or infographics from reliable sources. Use hashtags like #NOonHJR4, #LegalizeIdaho, and #KindIdaho to connect with the broader community. Your voice online can encourage others to pay attention and vote.
- Contact Your Legislators: Even though HJR4 is already on the ballot, it’s important for our elected officials to hear our outrage and opposition. Call or write your state representatives and senators. Let them know you strongly oppose HJR4 and expect them to respect the will of the people. If your legislator voted for HJR4, politely express your disappointment and that you’ll be voting no. If they opposed it, thank them and ask for their continued support in protecting voter rights. This pressure reminds current and future lawmakers that Idahoans are watching and will not tolerate attempts to silence voters.
- Spread the Word & Get Involved in Your Community: Talk to your neighbors, friends, coworkers, and family about HJR4. Many voters still might not be aware of this obscure-sounding “House Joint Resolution.” When they learn that it would block citizen-led marijuana legalization even if most people want it, they are often shocked. Host a house meeting or community discussion. Write a letter to the editor of your local newspaper voicing your stance. Every conversation can win another ally. The more Idahoans understand that HJR4 is an attack on their rights (and on patients in need), the more likely we are to defeat it at the polls.
- Show Up and Vote NO on Election Day: This is the big one – none of the above matters if we don’t turn out in huge numbers on November 3, 2026. Mark your calendar now. Make a plan for when, where, and how you will vote (whether early, absentee, or in-person on Election Day). Remind others to do the same. We need a loud and clear “NO” vote on HJR4 to protect our constitution. By voting, you honor all the Idahoans before us who fought to secure the initiative and referendum rights we have today. Don’t let their legacy be undone.
Election Day: November 3, 2026 – Vote NO on HJR4

Idaho’s future is on the line. HJR4 may be wrapped in legislative jargon, but at its heart it’s a simple question: Who gets to decide Idaho’s destiny – the people or a handful of politicians in Boise?
On Tuesday, Nov. 3, 2026, we must answer that by voting NO. Reject HJR4 to send a powerful message that we won’t allow our rights to be stripped away under the guise of “protecting” us from ourselves. Reject HJR4 to keep hope alive for medical cannabis access, for a more compassionate Idaho, and for the basic principle that Idahoans deserve a voice in Idaho’s laws.
The fight doesn’t end with a No vote – but without a No vote, the fight becomes infinitely harder. So rally your friends, spread the word, and prepare to make history at the ballot box. Together, we can defeat HJR4 and pave the way for a freer, healthier, and more democratic Idaho. Stand up for your rights and your neighbors – Vote NO on HJR4!
